As set forth in my declaration submitted on January 11, 2008, (Doc.

374), Plaintiffs timely served discovery requests seeking information regarding Defendants statute of limitations defense, including discovery designed to provide information regarding the method and manner of communication and recipients of communications. 3. Among the outstanding discovery served by Plaintiffs are Rule 30(b)(6)

deposition notices and a deposition notice served on Craig Chapman. Plaintiffs served the Rule 30(b)(6) notice on November 15, 2006 and an amended notice on February 28, 2007. (Doc. 374, Exhibits D and E.) On March 26, 2007, I spoke with Defendants counsel, Howard Shapiro and Amy Covert. They advised me that Defendants had identified four individuals who would testify regarding the Rule 30(b)(6) notices. These four individuals were Craig Chapman, Brian Marcotte, Kathleen Mathis and Cindy Brunelko. James McLeod, who submitted a declaration in support of Defendants motion, was not one of the people Defendants identified.
