On April 14, 2008, without seeking leave of Court, Plaintiffs filed a three-page Notice of Supplemental Citation of Authority Regarding Defendants' November 16, 2007 Motion for Reconsideration ("Notice"), discussing a 29-year old revenue ruling (Doc. 428). Defendants move here for leave to file a response to the Notice. Because Plaintiffs failed to cite the revenue ruling in their opposition to the motion for reconsideration (Doc. 361), Defendants had no opportunity to address it in their reply (Doc. 368). And, although Plaintiffs previously sought and obtained permission to file a sur-reply, the sur-reply also failed to cite the revenue ruling. (See Docs. 381, 393, 394.) Defendants have lodged separately with the Court their proposed response. As explained in the response, the revenue ruling cited by Plaintiffs provides no grounds for the Court to deny Defendants' pending Motion for Reconsideration.
