Although the Court's Rule 16 scheduling order then in effect called for the filing of quarterly notices, thereafter the parties filed a series of notices and settlement papers addressing their settlement discussions and ultimately their consummated partial settlement. See, e.g., Docs. 297, 298, 299, 308. 312.

vs. Honeywell Retirement Earnings Plan, Honeywell Secured Benefit Plan, Plan Administrator of Honeywell Retirement Earnings Plan, and Plan Administrator of Honeywell Secured Benefit Plan, Defendants. The parties submit this second1 joint notice of discovery and settlement pursuant to the Amended Fifth Revised Rule 16 Scheduling Order entered on November 14, 2007 ("Rule 16 Order") (Doc. 322). I. SETTLEMENT DISCUSSIONS

On February 8, 2008, the Court entered its Order and Judgment approving the parties' partial settlement (Doc. 402). Following negotiation and approval of the partial settlement, no further meaningful settlement discussions have occurred. The parties, however, remain open to further discussions at an appropriate time. II. DISCOVERY

Under the Rule 16 Order, discovery on the remaining claims is scheduled to close on June 9, 2008. The parties have been engaged in active discovery relating to the remaining claims. Depositions are scheduled and supplemental document production is ongoing. A. Pending Discovery Motions Pending before the Court are two discovery motions that impact the ongoing discovery including the Rule 30 (b) (6) depositions of the Defendants that are scheduled for May 12-14. 2008:

1. Plaintiffs' Renewed Motion to Compel Disclosure of Documents Withheld by Defendants on Claim of Attorney-Client and/or Work Product Privilege (Doc. 332); and 2. Defendants' Renewed Motion for Leave to Serve Questionnaire on Settlement Class Members (Doc. 342).

III.

OTHER PENDING MATTERS

In addition to the discovery motions mentioned above, pending before the Court are the following motions: 1. Defendants' Motion for Reconsideration (Doc. 323). 2. Defendants' Motion for Summary Judgment on Statute of Limitations (Doc. 340); and 3. Plaintiffs' Motion for Partial Summary Judgment Dismissing Defendants' Statute of Limitations Defenses (Doc. 343); Briefing on these three motions is complete.
