Defendants lodged a draft Joint Proposed Pretrial Order (#222), noting that Defendants had, as directed, initiated the preparation of the draft, but Plaintiff had not provided any input, and has not provided a phone number to allow personal consultation. Plaintiff was directed to show cause why his failure should not result in dismissal. (Order 10/20/6, #223 ) On October 20, 2006, Plaintiff responded (#224), indicating that he had not previously received a draft of the proposed order from Defendants, and asserting that he should have had an opportunity to participate in preparation of the order. Defendants have also responded (#225) that they had mailed a draft to Plaintiff, which was not returned undeliverable. IT IS THEREFORE ORDERED that Plaintiff shall have ten days from the filing of this Order to provide Defendants with his proposed modifications to their Proposed Pretrial Order (#222). Plaintiff shall further provide to defense counsel any phone number available for Plaintiff to facilitate communication between the parties. IT IS FURTHER ORDERED that within twenty days of the filing of this Order, the parties shall file their joint proposed pretrial order, as previously ordered.
