Pursuant to Federal Rule of Civil Procedure 56(f) and Local Rule 7.3, the parties file this stipulated request that the briefing schedule for Defendants' Motion for Summary Judgment Enforcing Settlement Agreement be extended. Defendants' Motion was filed on January 23, 2006. Plaintiffs requested, and Defendants agreed, to participate in expedited fact discovery on

the subject of settlement prior to Plaintiffs' filing of an opposition to the Motion. The parties have already exchanged and responded to certain written discovery requests, but wish to take depositions and further written discovery. The parties have yet to finalize a schedule for such discovery. Accordingly, the parties request that they be allowed to notify the Court when briefing of Defendants' Motion is complete so that the Court may set a date for oral argument of the Motion.
