The parties stipulate as follows: 1. Prior to the parties filing the April 28, 2006 Joint Claim Construction and

Prehearing Statement, Plaintiffs inadvertently modified Defendants' portion of the proposed constructions by adding language to the proposed construction for "ore bed"; 2. The parties now seek to correct this mistake and hereby stipulate and agree

to file the Corrected Joint Claim Construction and Prehearing Statement, attached as Exhibit 1; and 3. A proposed form of Order is attached hereto as Exhibit 2.
