Defendant Vega, through undersigned counsel, notifies the Court that she does not oppose Smith's request (dkt. 50) for an extension of time to respond to the Motion for Summary Judgment (dkt. 47) but she does oppose the requested length of the extension. Undersigned counsel contacted ASPC­Perryville/Santa Maria Unit to inquire about the air conditioning problem and was advised that: (1) the library is currently available for inmate use--and inmates are using it--despite such problems; and (2) a part has been ordered to fix the problem. If the Court grants Smith's requested extension to December 16, 2006, then Defendant respectfully asks the Court to include in its Order a briefing schedule that includes a Reply date of January 8, 2007, because counsel's staff resources will be limited during the last week of December.
