Defendants1 move to strike Plaintiff's exhaustion arguments in his "Response to Defendant's Notice of, and Opposition to, Plaintiff's Request for Entry of Default" at 4-8 on the ground that they constitute an improper surreply to Defendants' Motion to Dismiss which was fully briefed on April 22, 2005. See Local Rule 7.2 which allows for a motion, a response and a reply.

Maskell and Meaney. Defendant Freet is not an ADC employee. Defendants Dora Schriro, CO Chatt and CO Frisbee were dismissed from this action per the Court's August 19, 2004 Screening Order.
