20 Through their own independent efforts, Defendants recently obtained the identity of
21 plaintiffs current employer. As this Court is well aware, plaintiff did not provide complete .
22 earnings information. Schwab, therefore, intends to serve a subpoena duces tecum on her
23 employer this week: to obtain the requested information. While Schwab believes that it is not
24 under any obligation to do so, in the interest of professionalism, given plaintiffs pending
25 motion for protective order, Schwab wanted to apprise the Court and opposing counsel of
26 this development before serving the subpoenas.
27 Schwab must point out that it needs to act quickly because of plaintiffs refusal to
28 agree to extensions of the current case management deadlines. Schwab first requested that

1 plaintiff’s counsel stipulate to an extension of the deadlines, which she did during the same
2 telephone conference. However, days later, plaintiffs counsel announced that she would not
3 honor this agreement, despite the outstanding discovery, pending discovery motions and
4 depositions yet to be taken, most notably that of plaintiff.
5 Now, under the current case management schedule, Schwab must provide its
6 damages report in less than one month. Plaintiff has refused to provide complete damages
7 and mitigation information; therefore, Schwab must make haste to obtain this with enough
8 time to complete its report. Plaintiff has requested that this case move forward without
· 9 delay, however, simultaneously stonewalls the discovery process. Therefore, unless the 1
10 Court instructs Schwab that it may not subpoena plaintiffs current employer, Schwab
O 11 intends to subpoena the employer on Wednesday, December 21, 2005, after 2:00 p.m.
