Plaintiff Marcela Johnson moves to strike any reference to Schwab's argument that it seeks discovery of files containing information germane to "Plaintiff's employment history and mitigation" because that argument was not raised on their original motion and was not addressed by Plaintiff in her response. This is a perfect example of the

methodology used by Schwab to delay the prosecution of this case. In their original motion they provided a single rationale for seeking the releases ­ to obtain "records ...[that] will reveal plaintiff's unemployment earnings and earnings through similar government sources." [Reply, Dkt. No. 58 at p. 1:18-21; see also pp. 2:8-9; 3:8-4:11.] By adding new arguments Schwab continues to delay this case, generate additional fees and resourced, and violates basic rules of motion filing. For the foregoing reasons, Plaintiff respectfully requests this Court to strike all references to the new argument regarding "plaintiff's employment history and mitigation" found at the following page and line numbers in Schwab's reply: pp. 1:18-21; 2:8-9; 3:8Case 2:04-cv-00790-EHC Document 66 Filed 12/08/2005 Page 1 of 2
