Pursuant to Defendant's Motion to Continue, the government having no objection and good cause appearing, to wit: defense counsel needs additional time to complete discovery, IT IS ORDERED granting Defendant's motion and continuing trial to January 3, 2006, at 9:00 a.m. The Court finds that the ends of justice served by granting a continuance outweigh the best interest of the public and defendant in a speedy trial. This finding is based upon the Court's conclusion that the failure to grant such a continuance would deny the defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. 3161(h)(8)(iv). IT IS FURTHER ORDERED extending the deadline for filing motions to December 2, 2005.

IT IS FURTHER ORDERED that excludable delay under Title 18 U.S.C. ยง 3161 will commence on November 2, 2005, for a total of 62 days. DATED this 17th day of October, 2005.
