43, Further, Netcentives did not disclose the Cohen patent to the U.S. Patent Oflice at
any time during the proseention ofthe ‘4t2 patent. The Cohen patent was not disclosed to the
Patent Oi`§ce until the later prosecution ofthe ‘012 patent.
44. The ‘444 patent application, the issued *444 patent, the published 95/12175 PCT

45. On information and belief, the failure by Mr. Storey, Netcentives, and/or their
patent attorneys to disclose the foregoing items during the prosecution ofthe ‘870 patent was
motivated by an intent to deceive the U.S. Patent Oftice.
