This tirm represents Tl-lCl Company LLC ("THCI"). i write in
response to the letter from plaintiffs” counsel, Michael Lastowski, dated July 28,
2006 (Docket No. E8?). THCI will not burden the Court by arguing the merits of
this matter in correspondence. However, inasmuch as plaintiffs now have
consented to vacate the Facilities as requested by THCI in its pending Motion for
Partial Summary Judgment and Permanent injunction (Docket Nos. l49—15l),
T`I·lCl encloses a proposed form of order reflecting plaintiffs proposal and
requiring them to vacate the nine nursing home facilities at issue on August 3E,
2006.
