C.E. WYLIE CONSTRUCTION CO., a California corporation; TRAVELERS CASUALTY AND SURETY COMPANY OF AMERICA, a Connecticut corporation; and DOES 1 through 20, inclusive, Use-Defendants. On November 8, 2007, use-plaintiff Testing Engineers ­ San Diego, Inc. ("Testing Engineers"), filed a complaint. (Doc. No. 1.) To date no defendant has filed a response to the complaint. On December 26, 2007, Testing Engineers filed a motion for dismissal with prejudice. (Doc. No. 7.) The Court grants the motion filed by Testing Engineers and orders the case dismissed with prejudice.
IT IS SO ORDERED.
