On March 21, 2008, the Court convened a Case Management Conference in the above entitled 18 action. Appearing were David Hutch, Esq. and Derek Emge, Esq. on behalf of plaintiff; Brandon 19 McKelvy, Esq. on behalf of defendant. 20 Counsel submitted a joint discovery plan. Since it was entitled "Joint Motion Regarding the 21 Parties Discovery Plan," it is docketed as a pending motion. To clear the docket, that Motion (docket 22 No. 17) is denied without prejudice. 23 The Court and counsel discussed the current state of pending discovery and the potential time 24 line for the case. There is a significant discovery dispute with regard to the scope of class certification 25 discovery. Following the discussion, it is clear that the parties have meet and conferred and remain at 26 impasse. To address the issue, the Court sets the following schedule for defendant's Motion for a 27 Protective Order: 28 1. Defendant's Motion for Protective Order will be heard May 16, 2008 at 10:00 a.m.; 1

Defendant will file and serve the motion no later than April 18, 2008; Plaintiffs will file their opposition no later than May 2, 2008; and Defendant will file its reply no later than May 9, 2008.

The Court will convene a Case Management Conference at the conclusion of the motion hearing on May 16, 2008 at schedule the case at otherwise appropriate. IT IS SO ORDERED.
