Plaintiff, GLEN R. HAGEN, hereby applies for an Order to continue the telephonic Case Management Conference ["CMC"] now set for March 14, 2007, at 1:30 p.m. Plaintiff seeks a setting to the next available date for all parties. The undersigned, on March 11, 2008, at approximately 3:00 p.m. PDT, left a detailed message for opposing counsel, Jason R. Dawson, Esq., advising such an ex parte request would be made to this Court absent counsel entering into a joint stipulation. The undersigned has not had a response. (Please see attached AFFIDAVIT OF THOMAS R. GILL, ESQ., IN SUPPORT OF PLAINTIFF'S EX PARTE APPLICATION TO CONTINUE CMC.) Plaintiff did not request a continuance by noticed motion because of the proximity of the currently set date.
