R. Civ. P. 12(b)(1) and Fed. R. Civ. P. 12(b)(6). Plaintiff Ajaj has enclosed a recent decision by the United States Supreme Court, Wilkinson v. Austin, 125 S. Ct. 2384 (June 13, 2005), which provides support for his Third Claim for Relief, deprivation of a liberty interest, in his Second Amended Complaint.
