PLAINTIFF' INMATE STATEMENT DEMONSTRATING PAYMENT OF S MONTHLY FILING FEE AND UNOPPOSED MOTION FOR EXTENSION OF TIME TO MAKE MONTHLY FILING FEE PAYMENTS

COMES NOW, Plaintiff Ahmad M. Ajaj, by and through his counsel, Montgomery Little Soran Murray & Kuhn, P.C., and respectfully submits Plaintiff' s inmate statement demonstrating Plaintiff has made a monthly filing fee payment and moves for an extension of time pursuant to D.C.COLO.LCivR 6.1 to and including July 1, 2006, within which to make his outstanding monthly filing fee payments. The grounds for this Motion are as follows: 1. D.C.COLO.LCivR 7.1A Certification. Counsel for Plaintiff has spoken

with counsel for Defendants, Amanda Rocque. Ms. Rocque orally indicated she has no

objection to Plaintiff' request for an extension of time until July 1, 2006 to make his s outstanding monthly filing fee payments. 1. Plaintiff has been granted leave to proceed in forma pauperis pursuant to

28 U.S.C. §1915. Pursuant to §1915(b)(2), Plaintiff is required to make "monthly payments of 20 percent of the preceding month' income credited to his account" until s the filing fee is paid in full. 2. On June 1, 2006, Plaintiff received an Order directing Plaintiff to make his

monthly filing fee payments for the months of April and May 2006 or to show cause why he has no means by which to make the monthly payments and further ordered that Plaintiff make the required payment on the 15th of each month hereafter or show cause why he cannot make the payment. 3. Plaintiff made his monthly filing fee for April, which was received by the

Court on June 9, 2006. (See Exhibit 1.) 4. Plaintiff also made two additional filing fee payments on June 1, 2006 as

evidenced by Plaintiff' certified Inmate Transaction Receipt dated June 2, 2006. (See s Exhibit 2, Inmate Transaction Receipts). Plaintiff believes that due to an omission on the submission form to make the payment to the Court, Plaintiff' payment has not yet been s received by the Court. (See Exhibit 3.) Accordingly, Plaintiff requests an extension of time to make his outstanding filing fee payments for May and June 2006. WHEREFORE, Plaintiff Ahmed M. Ajaj respectfully requests an extension of time to and including July 1st, 2006, within which to make his outstanding monthly filing fee payments. Dated: June 14, 2006.
