CASE NO. 03-cv-02485 MSK-PAC Camille Melonakis-Kurz, individually and on behalf of other similarly situated employees, Plaintiffs, v. Heartland Home Finance, Inc., Defendant.

ORDER FOR APPROVAL OF SETTLEMENT ________________________________________________________________________ This matter came before the Court based upon submissions of the parties for approval of the settlement set forth in the Stipulation for Settlement. The parties

conducted a thorough investigation into the facts of the action, including an extensive review of thousands of documents, taking over sixty (60) depositions, participating in three mediation sessions, and diligently pursuing an investigation of Plaintiffs' claims against Defendant Heartland Home Finance ("Heartland"). The Court having considered all papers filed and proceedings had herein and otherwise being fully informed and good cause appearing, HEREBY ORDERS that: 1. Pursuant to the procedures for a collective action under the Fair Labor Standards Act and as otherwise required, this Court hereby approves the settlement set forth in the parties' Stipulation of Settlement and finds that the settlement is, in all respects, fair, reasonable and adequate to Plaintiffs. The Stipulation of Settlement is approved, and the parties are hereby directed to perform pursuant to its terms.

The parties shall jointly file a Stipulation and Order for Dismissal by October 6, 2006 setting forth which Plaintiffs shall be dismissed with or without prejudice. In light of the settlement, all proceedings are stayed pending dismissal.
