Coan, jointly move to VACATE the evidentiary hearing currently scheduled in the above-entitled matter for Thursday, May 11, and Friday, May 12, 2006, and all other currently scheduled proceedings and deadlines. The parties have settled this case, subject to the Court's approval. With the settlement of the case, the evidentiary hearing and all other currently

scheduled proceedings and deadlines are no longer necessary, and the parties believe that their efforts should be used to effectuate the terms of the settlement. The terms and conditions of the settlement are set forth in the Stipulation of Settlement and Proposed Order for Approval of Settlement filed contemporaneously with this motion, and require the parties to file a Stipulation for Dismissal of this action on or before October 6, 2006.
