JOINT STIPULATION OF DISMISSAL WITHOUT PREJUDICE

The parties, Plaintiff, Danny O. Daniels; and Defendant, City and County of Denver (hereinafter "City"), a municipal corporation; hereby jointly stipulate to the dismissal of this action without prejudice pursuant to Fed.R.Civ.P. 41(a)(2), under the following terms and conditions: 1. The City agrees that dismissal will render moot its pending Motion for Sanctions

and/or that it waives recovery of any monies or other sanctions that may be or may have been awarded by the Court in a ruling on said motion. 2. Each party agrees to bear its own costs and attorney's fees, subject to the

provisions of Fed.R.Civ.P. 41(d) in the event that Mr. Daniels should commence a second action based upon or including the same claim against the City. 3. Dismissal shall be effective only upon an Order of the Court in accordance with

Fed.R.Civ.P. 41(a)(2).
