Defendants David Kieffer and Behavioral Associates, Inc., ("Dr. Kieffer") by and through counsel, Treece, Alfrey, Musat & Bosworth, P.C., hereby submit their Certificate of Compliance with D.C.COLO.LCivR 54.1. A reasonable effort has been made to contact Plaintiffs in order to discuss any disputes regarding costs set forth in Defendant David Kieffer and Behavioral Associates, Inc.'s Bill of Costs. The undersigned sent letters to Plaintiffs, dated November 8, 2005, to discuss this Bill of Costs prior to the hearing. This letter was sent both First-Class and via Certified Mail, Return Receipt Requested. A copy of that letter is attached as Exhibit 1. A copy of the Return Receipt, signed by Plaintiff Jacob Himmler, is attached as Exhibit 2. Finally, the undersigned sent a letter

to Plaintiffs, dated November 15, 2005, advising them of the change in hearing date of the Bill of Costs, and again requested Plaintiffs contact the undersigned to resolve this matter. A copy of that letter is attached as Exhibit 3. The undersigned also attempted to contact Plaintiffs via telephone by calling (970) 532-2935, but was unable to reach Plaintiffs. As the time of filing this Certificate, the undersigned has not been able to reach Plaintiffs to discuss the Bill of Costs in advance of the hearing scheduled for 8:30 a.m. on November 22, 2005.
