call him to confer about the Bill of Costs. See, Exhibit A, letter dated October 14, 2005. To date Plaintiff Himmler has not called defense counsel. 2. Defense counsel also called Plaintiff Himmler several times at (970) 532-2925, a

number listed in the white pages. This phone did not have an answering machine and defense counsel was unable to reach Plaintiff Himmler.
