Dear Counsel:
We are writing in reference to the August 26, 2005 letter from counsel for defendanWthird-party plaintiffs.
On September 8, 2005, our expert can bring the Denver Fuel Fire coinponenls to Mr. McSwaui's laboratory in Pensacola, Florida, or to ESI (if more feasible in light of Hurricane Katrina). If, as we anticipate, we also will be in possession of components from the Atlanta incident, those also will be brought. Of course, only non-destructive testing will be permitted, and only in the presence OF our expert aid couiisel for British Airways.
Insofar as the suggestcd extension of time for service of expert disclosures is concerned, if defendants' counsel wishes to file an unopposed motion to extend all expert disclosure dates by fifteen (15) days, or soine other agreeable length of time, I respectfully suggest that the inotiori be filed without further delay. Otherwise, the currenl sched~ile reniaiiis in effect for all parties, aid we do object to defendants attempting to extend their timc to serve their expert disclosures. The belated demand for inspection, particularly with respect lo mother iiicrdent, is an inappropiiate and
