COMES NOW AIRCRAFT SERVICE INTERNATIONAL, INC., by and through undersigned counsel, pursuant to Fed. R. Civ. P. 41(a)(2), and states as follows: 1. Third Party Plaintiff Aircraft Service International, Inc. ("ASII") presented

affirmative claims for relief against, among others, Third Party Defendant Whittaker Controls,

Inc. 2. ASII has decided to proceed in the instant matter without further prosecution

of the claims it raised against Whittaker Controls, Inc. 3. Counsel for Whittaker Controls, Inc. has been consulted on this decision and

consents to the dismissal, without prejudice. 4. There are no cross-claims or counterclaims raised by Whittaker Controls, Inc. that

require the Court's action. 5. Consistent with the provisions of D.C.Colo.LCiv.R 7.1, counsel for all other

parties have been contacted, and they unanimously have consented to the relief requested. WHEREFORE, Defendant AIRCRAFT SERVICE INTERNATIONAL, INC., with the consent of all other parties to this matter, respectfully prays that this Honorable Court enter an Order that the claims raised in the Third Party Complaint, solely as against Whittaker Controls, Inc., be dismissed without prejudice, each party to bear its own costs and fees.
