AND QWEST CAPITAL FUNDING TO PLAINTIFF'S MOTION FOR LEAVE TO FILE "RESPONSIVE MEMORANDUM" (Docket No. 131) ___________________________________________________________ Qwest Communications International Inc. ("Qwest" or the "Company") and Qwest Capital Funding, Inc. ("QCF") respectfully oppose Plaintiff's request for leave to file a sur-reply (captioned "Responsive Memorandum"). Plaintiff's motion for leave and the accompanying proposed sur-reply continue the Plaintiff's practice of obliging Qwest to spend time and money responding to duplicative filings. A review of Plaintiff's motion demonstrates that the proposed surreply offers nothing new, nor does Plaintiff suggest in its motion that Qwest raised any issues for the first time its reply to which Plaintiff must now respond. Indeed, Plaintiff does nothing more than reassert its earlier arguments.

In both the motion for leave and the proposed sur-reply, Plaintiff repeatedly mischaracterizes Qwest's positions in this litigation (without any citation to Qwest's briefs) and the law applicable to this matter. To give just one example, Plaintiff states Qwest did "not controvert the position taken by the plaintiff in its original Opposing Memorandum that `The Law of the Case' may require Judge Krieger's position with respect to the effectiveness of the `toll' of the relevant Statute of Limitations to be accepted by Judge Blackburn." (Proposed Sur-reply at 4.) Qwest, of course, devoted two pages of its Reply brief to rejecting that very argument. (Reply at 3-4.) In addition, continuing its pattern of ignoring this Court's rules, Plaintiff offers a sur-reply that exceeds the permitted length for reply briefs, among other deficiencies. See REB Civ. Practice Standard V.B. For the foregoing reasons, this Court should deny Plaintiff's motion to file a "Responsive Memorandum." If the Court grants Plaintiff's motion and accepts the "Responsive Memorandum" for filing, it should also permit Qwest an opportunity to respond on the merits. Plaintiff does not contest such relief.
