UNOPPOSED MOTION FOR ORDER EXTENDING TIME TO ANSWER COMPLAINT Defendant Qwest Communications International Inc ("Qwest") requests that this Court enter the Proposed Order Extending Time To Answer Complaint that is attached to this motion.1 As good grounds therefore, Qwest states as follows: 1. On September 24, 2007, this Court granted in part and denied in part

Qwest and Qwest Capital Funding's Motion to Dismiss (Docket No. 141). The Court dismissed all claims against Qwest Capital Funding and dismissed counts three, four, five and six of the Complaint filed by Shriners in Shriners Hospitals for Children v.

Pursuant to D.C.COLO.LCivR. 7.1(A), undersigned counsel certify that they have conferred with counsel for all parties and have advised them of this Motion for Order Extending Time To Answer Complaint. Counsel for all parties have consented to this Motion.

Qwest et al., Case No. 06-cv-002189 ("Shriners II"). (Docket No. 141 at 9). The Court otherwise denied Qwest's Motion to Dismiss. (Id.) 2. Qwest's Answer to the remaining Counts of the Shriners II Complaint

would be due ten days after notice of the Court's decision. Fed. R. Civ. P. 12(a)(4)(A). Excluding weekends and holidays, see Fed. R. Civ. P. 6(a), Qwest's Answer would be due on October 9, 2007. 3. Qwest requests that the Court grant Qwest an extension of time to answer

the Shriners II Complaint up to and including December 4, 2007. 4. Qwest submits that no party would be prejudiced by such an extension.

Qwest and Plaintiff Shriners Hospitals for Children ("Shriners") are already parties to Shriners v. Qwest et al., Case No. 04-CV-0781 ("Shriners I"). Qwest has already answered the Shriners I Complaint, and the parties are engaged in discovery. 5. Qwest submits that granting this extension would conserve resources,

would aid the efficient administration of justice, and provides good cause to allow an extension of time.
