Defendant's Motion for Leave to File Motion for Summary Judgment and Brief in Support Thereof Out of Time and in Excess of Page Limitation [#78], filed March 2, 2006, is GRANTED in part and DENIED in part. Defendant City and County of Denver, Colorado shall have until March 8, 2006, in which to file the motion for summary judgment and brief in support. However, the request for the page extension of 30 pages, is DENIED. Counsel is directed to this court's practice standard in formatting requirements for motions for summary judgment, REB Civ. Practice Standard V.H.3.b. If defendant is unable to comply with the page limitations after redrafting the brief, they may file an independent motion showing good cause for exceeding the page limitations.
