ORDER ENTERED BY MAGISTRATE JUDGE CRAIG B. SHAFFER Upon telephonic communications from counsel on January 27, 2006, it has come to the attention of the court that parties anticipate filing a motion to vacate the trial date. Counsel are put on notice that absent an order from Chief Judge Babcock vacating the April 24, 2006, trial date, the final pretrial conference, set for February 1, 2006, at 9:30 a.m. will go forward. Therefore, it is hereby ORDERED that in accordance with FED.R.CIV.P. 16(d) trial counsel MUST be physically present for the final pretrial conference. No telephonic appearances will be permitted. A proposed final pretrial order is to be submitted no later than 5:00 p.m. on January 30, 2006. DATED: January 27, 2006
