COURTROOM MINUTES / MINUTE ORDER HEARING: FINAL PRETRIAL CONFERENCE Court in session: 10:46 a.m.

Court calls case. Appearance of counsel. The Court notes that under FED.R.Civ.P. 16(d), the Final Pretrial Conference " ...shall be attended by at least one of the attorneys who will conduct the trial for each of the parties..." Mr. Gleason advises the Court that Mr. Cross will be the only attorney participating in the trial for the Defendant, but he is presently in depositions and unable to attend this conference. The Court proceeds with the Final Pretrial Conference in his absence. It is ORDERED: The proposed FINAL PRETRIAL ORDER is not approved; The parties shall submit a SUPPLEMENTAL FINAL PRETRIAL ORDER on or before MAY 05, 2006.

The Supplemental Final Pretrial Order shall contain more descriptive summaries of anticipated testimony of witnesses, including information about what subjects will be discussed and what opinions will be offered. Also, any " catch all"categories of exhibits must be omitted from the Supplemental Final Pretrial Order. As the Court anticipates reviewing and signing the Supplemental Final Pretrial Order, no further Final Pretrial Conference is set.
