Notice is hereby given that Scott Chamberlain, Intrepid, L.L.C., William D. Balough, Janice M. Balough, Taylor Restaurant Holdings, L.L.C., and Jeffery M. Taylor, Plaintiffs, hereby appeal to the United States Court of Appeals for the Tenth Circuit from an order granting in part and denying in part Defendants' Motion to Dismiss Plaintiffs' Complaint Pursuant to Federal Rule of Civil Procedure 12(b)(6). Although the District Court entered the order dismissing the claims subject to this appeal on March 25, 2005, the order did not become appealable until the District Court entered an order dismissing the remaining claims on July 18, 2005.
