Plaintiff Susan Pena and Defendants Travelers Property Casualty Company of America and Suzanne Liening, by and through their respective undersigned attorneys, submit the following status report: 1. On October 20, 2005, the parties participated in a mediation with Steve Clymer of

Accord Dispute Resolution Services, Inc. The parties report that this mediation resulted in a settlement of all claims in this case. 2. The parties anticipate filing with this Court a joint motion to dismiss with

prejudice within 30 days. 3. The pending motion for summary judgment filed by Defendants is now moot and

thus withdrawn by Defendants subject to entry of an order dismissing the case with prejudice.
