Plaintiff Susan Pena and Defendants Travelers Property Casualty Company of America and Suzanne Liening, by and through their respective undersigned attorneys, respectfully request that the Court vacate the October 26, 2005 settlement conference: 1. By Minute Order dated September 23, 2005, the Court ordered that the parties

participate in a settlement conference on October 26, 2005 at 1:30 p.m. with Magistrate Judge Michael J. Watanabe. 2. After this Minute Order, however, the parties scheduled a private mediation for

October 20, 2005 with mediator Steve Clymer of Accord Dispute Resolution Services, Inc. 3. As a result, the parties seek to vacate the settlement conference with the Court.
