MINUTE ORDER Entered by Michael E. Hegarty, United States Magistrate Judge, on June 12, 2006. Before the Court is Defendant GeoSyntec' Motion to File an Exhibit under Seal. When a s party requests a seal order, the Court must carefully balance the competing interests that are at stake in the particular case. See Nixon v. Warner Communications, 435 U.S. 589, 599 (1978). The ultimate decision to issue an Order to Seal lies in the trial court' sound discretion. Id. In balancing s the respective interests of the parties and the public, the Court finds that Defendant has made a showing of compelling reasons for sealing the document tendered to the Court. No objections having been filed pursuant to D.C.COLO.LCivR 7.2(D), and based upon a showing of compelling reasons, Defendant GeoSyntec' Motion to File Exhibit 10 to Motion to s Compel Discovery Regarding Damages and for Sanctions Under Seal [Filed June 2, 2006; Docket #119] is granted. The document held at Docket #118 shall be placed and held under seal unless or until a further order of this Court directs otherwise.
