GEOSYNTEC'S UNOPPOSED MOTION FOR EXTENSION OF TIME TO RESPOND TO PLAINTIFF'S MOTION TO SUPPLEMENT THE RECORD REGARDING DEFENDANT GEOSYNTEC'S MOTION FOR SUMMARY JUDGMENT
Defendant GeoSyntec Consultants, Inc. ("GeoSyntec") moves the Court for an

extension of time, to and including November 29, 2006, within which to respond to

Plaintiffs Motion to Supplement the Record Regarding Defendant GeoSyntec
Consultants, Inc.'s Motion for Summary Judgment (the "Motion to Supplement"). In

support thereof, GeoSyntec states:
CERTIFICATE OF COMPLIANCE WITH D.C.COLO.LCivR 7.1(A)
Undersigned counsel hereby certifies that all counsel have conferred regarding

the deadline at issue in this Motion. No party opposes the deadline of November 29,
2006 for submission of responses to Plaintiffs Motions to Supplement the Record, filed
with respect to both Defendant TIC's Motion for Summary Judgment and Geosyntec's
Motion for Summary Judgment.

1. On October 27,2006, Plaintiff

filed his Motion to Supplement, seeking to

add exhibits and excerpts from several depositions to his Response in Opposition to Defendant GeoSyntec's Motion for Summary Judgment, which Plaintiff filed on January
10, 2006.

2. On October 30, 2006, Plaintiff also filed two dispositive motions, a Motion
for Summary Judgment Regarding Plaintiffs CERCLA Liabilty and a Motion and
Memorandum for Partial Summary Judgment That Mr. Friedland's CERCLA Response
Costs for Government Directed Remediation Were Consistent With the National

Contingency Plan. Responses to these motions are due on November 29, 2006.

3. GeoSyntec requires additional time to prepare its response to the Motion
to Supplement, and the parties have agreed that responses to all three motions filed by
Plaintiff shall be submitted by the same deadline, November 29, 2006.
4. Pursuant to D.C.Colo.LCivR 6.1 (D), undersigned counsel has served a

copy of this Motion on GeoSyntec's client representative, Paul Sanner, and on all
counsel of record as reflected in the certificate of service below.

WHEREFORE, Defendant GeoSyntec Consultants, Inc. respectfully requests an

order granting an extension of time, to and including November 29, 2006, within which

to respond to Plaintiffs Motion to Supplement the Record Regarding Defendant
GeoSyntec Consultants, Inc.'s Motion for Summary Judgment.
