Defendants TIC ­The Industrial Company and GeoSyntec Consultants, Inc. (" Defendants" move under F.R.Civ.P. 56(c) for entry of judgment in their favor against ) Plaintiff dismissing with prejudice all claims for relief alleged in the Amended Complaint. The basis for this Motion is that there is no dispute that the Plaintiff has been fully compensated for all payments he made to the United States and the State of Colorado. Accordingly, he cannot establish an essential element of a claim for contribution under 42 U.S.C. § 9613. In support, Defendants incorporate here by reference the authorities and exhibits attached to Defendants Brief In Support of Joint Motion for Summary Judgment on Damages.
