JACK DOWELL, Defendant. __________________________________________________________________ ORDER DENYING MOTION TO COMPEL SURRENDER OF CASE FILE __________________________________________________________________ On June 21, 2007, Jack Dowell filed a motion to compel attorney Jody Reuler to surrender the case case in 01-cr-395-M alleging that Mr. Dowell should be entitled to the complete file of his court-appointed attorney to enable the defendant to file a motion to vacate sentence under 28 U.S.C. ยง 2255 based on ineffective assistance of counsel. The motion to compel is premature. The matter may be raised after the filing of the defendant's motion if the motion shows sufficient cause for considering the issue.
