In his motion, Mr. Moore states, " the current time, there is pending in the Tenth Circuit Court of Appeals an At appeal of a § 2255 petition filed by Mr. Pritchard which asserts, among other things, incompetence of counsel in connection with the undersigned' prior representation of s Mr. Pritchard in this very case. Counsel submits it is inappropriate for him to be appointed as counsel in this matter while he is simultaneously being claimed to be incompetent by this client." I agree with Mr. Moore that it is inappropriate for him to be appointed as counsel in this matter. Accordingly, it is ORDERED that the Motion to Withdraw as Counsel for Donald Pritchard (#124), filed March 16, 2006, is GRANTED. It is FURTHER ORDERED that Raymond P. Moore is no longer counsel of record in this case. It is
