SECOND UNOPPOSED MOTION FOR EXTENSION OF TIME TO FILE RESPONSE TO MOTION FOR SUMMARY JUDGMENT Defendant Jamie Goldstein submits this Second Unopposed Motion for Extension of Time to File Response to Motion for Summary Judgment pursuant to D.C.Colo.L.Civ.R. 7.1 and states as follows: 1. On November 9, 2005, Plaintiffs, other than John P. Barbee (collectively, the

"Moving Plaintiffs") filed a Motion for Summary Judgment (the "Motion"). 2. The Motion seeks summary judgment only on Plaintiffs' tenth claim for relief

listed in their Second Amended Complaint. However, the Motion seeks judgment in the amount of $550,000, the amount currently on deposit with the clerk of the court, based upon Jamie Goldstein's deposit of $675,332.43 in compliance with the Court's December 14, 2004, entry of

an Amended Preliminary Injunction. The Motion also includes voluminous attachments and implicates numerous factual and legal issues. 3. On December 7, 2005, this Court granted Mr. Goldstein's Unopposed Motion for

Extension of Time to File Response to Motion for Summary Judgment and permitted Mr. Goldstein until January 4, 2006, to respond to the Motion. That same day, the Court entered an order permitting Plaintiff John P. Barbee (the "Trustee") to file a response to the Motion by January 9, 2006. 4. Mr. Goldstein requests that the Court set January 9, 2006, as the date by which he

must file a response to the Motion. An additional extension of time of five days will not prejudice any party nor affect any other deadlines in this case. Counsel for Mr. Goldstein has conferred with counsel for Moving Plaintiffs, who are not opposed to such an extension. Mr. Goldstein has filed a proposed order with this Motion.
