("MD MARK"), by and through her attorneys, Pelz & Associates, P.C., files the following Bill of Costs: CERTIFICATION PURSUANT TO LOCAL RULE 7.1A Counsel for Plaintiff has attempted to confer with counsel for Defendants. Plaintiff's counsel paralegal conferred with Greg Goldberg regarding the filing of the Bill of Costs. It has taken an inordinate amount of time to prepare the Plaintiff's Bill of Costs. A copy of the Bill of Costs was provided to defense counsel on Thursday, October 4, 2007, but due to the deadline to file the Bill Costs, Plaintiff's counsel is filing the Bill of Costs on October 5, 2007. It is

believed that Plaintiff's counsel and the Defense counsel have agreed to continue discussing the Bill of Costs.

INTRODUCTION A prevailing party is entitled to recover costs against a defendant. Fed.R.Civ.P. Rule 54(d). The types of costs that are generally taxed in favor of the prevailing party in a federal litigation are set by statute 28 U.S.C. § 1920, 1923 and 1924. Fed.R.Civ.P. Rule 54(d) lists seven separate categories of costs specifically allowed and Form AO133 "Bill of Costs" lists nine separate categories of costs specifically allowed, plus one category of other costs allowed. The list of allowable costs is not exhaustive but merely illustrative of the costs the Court should consider. In many cases, the district court will also be precluded from denying costs merely because the prevailing party failed to pray for them in a pleading. Flynn v. AK Peters, Ltd., 377 F.3d 13, 26 (1st Cir. 2004) and Port of Stockton v. Western Bulk Carrier KS, 371 F.3d 1119, 1121-22 (9th Cir. 2004). The Circuits are not always uniform in their approaches to these various factions. Knology, Inc. v. Insight Commc'ns Co., 460 F.3d 722 (6th Cir. 2006). One Court of Appeals has explained that denying costs is "in the nature of a severe penalty" and, as such, the party opposing the taxing of costs will be obligated to offer a reason why the prevailing party ought to be "penalized" by a refusal of costs. Rodriguez v. Whiting Farms, Inc., 360 F.3d 1180, 1190-91 (10th Cir. 2004). Moreover, once the prevailing party demonstrates the amount of its costs and that they fall within an allowable category of taxable costs, the prevailing party enjoys the "strong presumption" that its costs will be awarded "in full measure". Concord Boat Corp. v. Brunswick Corp., 309 F.3d 494, 497-98 (8th Cir. 2002), mandate amended, 318 F.3d 1156 (8th Cir. 2003). A. CLERK AND OTHER FEES AS AUTHORIZED BY FED.R.CIV.P. RULE 54(D). Fees to "exemplify" documents (which may include reimbursement for many methods of illustration, including models, charts, graphs, and sometimes even computerized presentation systems) are taxed in favor of the prevailing party in a federal litigation. Cefalu v. Village of Elk Grove, 211 F.3d 416, 427-28 (7th Cir. 2000). Fees to print copies of papers necessary for use in the case (BDT Prods., Inc. v.
