JOINT REQUEST FOR STATUS CONFERENCE

On January 16, 2008, the Tenth Circuit: (1) held that non-settling defendants Joseph P. Nacchio and Robert Woodruff have standing to challenge the partial settlement reflected in this Court's Partial Final Judgment and Order of Partial Dismissal with Prejudice dated September 29, 2006 ("PFJ"), New England Health Care Employees Pension Fund, et al. v. Woodruff, et al., No. 06-1482 (10th Cir. Jan. 16, 2008) [Docket No. 1110] ("Opinion") at 7-11; and (2) remanded this case to this Court "so that it might make appropriate findings and conclusions with respect to Mr. Nacchio and Mr. Woodruff's objections to the settlement," Id. at 3. On April 2, 2008, the Tenth Circuit denied Qwest's Petition for Panel Rehearing and its Petition for Rehearing En Banc, and on April 10, 2008, issued the Mandate returning jurisdiction to this Court. The parties believe that the Court (and the parties) would benefit from holding a status conference to discuss how the Court wishes to proceed in light of the Tenth

Circuit's remand. Qwest and Lead Plaintiffs believe the Court would benefit from further briefing given the significant amount of time that has elapsed since the original briefing before this Court, and at the status conference will request an opportunity for the parties to submit briefs on the issues presented by the remand. Counsel for Messrs. Nacchio and Woodruff believe that, given the extensive papers already before the Court on these issues and the Tenth Circuit's mandate, no further briefing is necessary, except to the extent this Court desires input from the parties on any particular issue.
