GREGORY M. CASEY'S UNOPPOSED MOTION FOR AN EXTENSION OF TIME TO ANSWER PLAINTIFF'S FIRST AMENDED COMPLAINT Defendant Gregory M. Casey respectfully moves this Court pursuant to Fed. R. Civ. P. 6(b) and D.C. Colo. L. Civ. R. 6.1(B) for an extension of time in which to answer Plaintiff's First Amended Complaint. In support thereof, Mr. Casey states as follows:

Plaintiff filed its initial Complaint in this action on February 9, 2004, and filed its First Amended complaint on July 7, 2004. On September 10, 2004, Mr. Casey filed a Motion to Dismiss Plaintiff's First Amended Complaint.

On September 12, 2005, the Court issued an Order Concerning Defendants' Motions to Dismiss re: Complaint of Plaintiff Stichting Pensioenfonds ABP. In that Order, the Court granted in part and denied in part Mr. Casey's Motion to Dismiss.

3.

Mr. Casey now requests an extension of time up to and including November 14, 2005, to answer Plaintiff's First Amended Complaint.

4.

The First Amended Complaint is 308 pages long with over 850 separately numbered paragraphs that contain thousands of allegations concerning alleged conduct over a period of several years. Given the complexity of this matter, the importance of completeness and accuracy, and the time-consuming nature of factchecking, Mr. Casey respectfully requests the additional time to file his Answer.

Pursuant to D.C. Colo. L Civ. R. 7.1(A), Richard L. Jacobson, one of the counsel for Mr. Casey, has conferred with Sharan Nirmul, counsel for Plaintiff, who stated that Plaintiff does not oppose Mr. Casey's request for this extension of time.

6.

Attached to this Motion is a proposed Order granting Mr. Casey's request for an extension of time.

7.

Pursuant to D.C. Colo. L. Civ. R. 6.1(D), a copy of this Motion has been served on all attorneys of record as reflected in the attached Certificate of Service.
