GOVERNMENT'S STATUS REPORT

The Government, by and through William J. Leone, United States Attorney, respectfully submits the following status report concerning the need for a continued stay of discovery in the above captioned case. 1) The Government strongly believes that a continued stay is necessary in the

interests of justice and is supported by the relevant case law previously cited to the Court. 2) Continuation of the stay will not adversely affect the parties' rights for

several reasons: a) The parties to the Consolidated Class Action have advised the Court that they have reached agreement in principle to settle all claims except as to defendants Nacchio and Woodruff. As a result of that settlement, the

Government is advised that the parties will seek a stay of all discovery pending finalization of the settlement. b) To the extent that there are additional parties to the SEC action who are not part of the stipulated stay in the Consolidated Class Action, they have been permitted sufficient discovery, and have had access to millions of pages of material to allow them to productively proceed to evaluate the case without compromising the interests of the Government. c) The stay is essential to avoid compromising the criminal investigative process. 3) The Court previously established January 13, 2006 as a date to consider

whether the stay should continue beyond the end of this year. That date remains a logical and meaningful time to consider the issue. The Government cannot further comment on the status of its criminal investigation. 4) There remains a need to maintain a coordinated approach to discovery

between the SEC Action, the remnants of the Consolidated Class Action, and the state court litigation pending in various state courts, especially California. Notwithstanding this Court's order that no discovery occur except as expressly authorized or agreed upon, the CALSTRS Plaintiffs have begun to notice additional discovery, apparently on the theory that all discovery is permitted except as expressly prohibited. A hearing/status conference is presently scheduled for December 22, 2005 in San Francisco, at which this issue may arise. The

Government respectfully advises the Court that the interests of all the parties, and the interests of this Court's remaining cases, will continue to be better served if the various state court actions continue to proceed in a coordinated fashion and suggests to the Court that it do whatever it can appropriately do to encourage continued coordination with the state court.
