Tempest ("Mr. Tempest"), by and through his counsel, hereby moves the Court for an order allowing Mr. Tempest up to and including November 11, 2005 to file a response to Plaintiff Stichting Pensioenfonds ABP's Motion for Reconsideration. As grounds, Mr. Tempest states as follows: 1. On September 12, 2005, the Court issued its order Concerning Defendants'

Motion to Dismiss re: Complaint of Stichting Pensioenfonds ABP ("Order"). In that Order, the Court, among other rulings, dismissed as to Mr. Tempest Plaintiff's claim under Section 20(a) of the 1934 Securities Exchange Act for control person liability. On September 26, 2005, Plaintiff filed a Motion for Reconsideration of this portion of the Court's Order. 2. Through inadvertence Plaintiff's motion did not get docketed on Mr. Tempest's Having recognized the

approximately 1:00 p.m. on Friday, November 4 to explain the situation and seek Plaintiff's consent to allowing Mr. Tempest a short extension of the time up to November 11 to file his response. Plaintiff's counsel, Michael Barry, was not available so Mr. Tempest's counsel left voicemail explaining the situation as and asking whether Plaintiff's would agree to the relief requested herein. As of the filing of this motion, Mr. Tempest's counsel has not heard back from Plaintiff's counsel. 3. Allowing Mr. Tempest a short extension of time to file his response will not

prejudice Plaintiff or any other party to this action. Nor will it impede the progress of this case. Mr. Tempest has answered the Complaint, discovery is progressing, and Mr. Tempest's deposition has not been scheduled. Additionally, allowing Mr. Tempest a brief extension to respond to Plaintiff's motion will further the interests of justice by allowing Mr. Tempest to address the arguments raised in Plaintiff's motion. 4. For these reasons, Mr. Tempest respectfully requests that the Court grant his

motion and allow Mr. Tempest up to and including November 11, 2005 to file a response to Plaintiff's Motion for Reconsideration. A proposed order is tendered herewith. 5. Local Rule 7.1A Certification: As noted, Mr. Tempest's counsel left a

telephone message with Plaintiff's counsel, Mr. Barry, asking whether Plaintiff would consent to the relief requested in Mr. Tempest's motion. Counsel for Mr. Tempest has not heard back from Plaintiff's counsel as of the filing of this motion.
