JOSEPH P. NACCHIO'S UNOPPOSED MOTION FOR LEAVE TO FILE A BRIEF IN EXCESS OF 15 PAGES IN OPPOSITION TO LEAD PLAINTIFFS' FEBRUARY 27, 2006 MOTION FOR FINAL APPROVAL OF THE CLASS ACTION SETTLEMENT

Comes now, Joseph P. Nacchio, by and through undersigned counsel, and respectfully requests the Court grant him leave to file a motion in excess of the 15-page limit set forth at REB Civ. Practice Standard V.A.1. (Page Limitation). As grounds therefore, Mr. Nacchio states as follows: 1. On February 27, 2006, Lead Plaintiffs filed a "Motion for Final Approval

of Class Action Settlement and Plan of Allocation of Settlement Proceeds." (Doc. 928). 2. 3. Lead Plaintiff's Motion for Final Approval is 29 pages in length. At the time of filing that motion, Lead Plaintiffs also filed an unopposed

motion for leave to file the oversized brief, explaining that "the importance of the issues

and the overall complexity of this case" warranted derivation from the Court's practice standards. (Doc. 927). 4. Mr. Nacchio will need more than 15 pages to respond in light of the

partial settlement proposed by Lead Plaintiffs, and the position in which it places Mr. Nacchio. Of the fourteen defendants in this action, Mr. Nacchio is one of only two "nonsettling defendants," who have been excluded from the settlement by the settling parties. Despite his exclusion, the proposed settlement purports to extinguish ­ without his consent or any compensation ­ Mr. Nacchio's rights, notably, his contractual and statutory rights to indemnification from Qwest for amounts that may be paid to settle plaintiffs' claims against him. 5. Thus, Mr. Nacchio respectfully requests that Court grant him leave to file

a brief in opposition of up to 25 pages in length. 6. Pursuant to D.C.Colo.LCivR. 7.1(a), counsel for Mr. Nacchio has

conferred with Lead Plaintiffs regarding this motion. Lead Plaintiffs do not oppose Mr. Nacchio filing an objection up to 25 pages in length. 7. Pursuant to REB Civ. Practice Standard V.A.1. (Page Limitations), no

hearing is requested in this matter. 8. A proposed order has been submitted herewith.
