Counsel for defendant recounts efforts to contact and give notice to Mr. Namoko of this hearing. Proper notice has been given. The hearing will proceed.

Mr. Namoko has failed to demonstrate an entitlement to the fairness hearing under paragraph 54 of the consent decree and has otherwise chosen to proceed by independent action. His request for a fairness hearing at (Doc. # 152 and 154) is denied. Mr. Namoko's Request for Default Judgment (Doc. #158) is DENIED.
