JOHN REILLY, et al., Defendants. _______________________________________________________________________ JUDGMENT _______________________________________________________________________ Pursuant to an Order entered by Judge Zita L. Weinshienk on December 10, 2001, defendants Gary Watkins, Jim Day, Mary Carter, Richard Watson, Lt. Strode, Lt. Smelzer and any and all Jane and John Does were dismissed. The plaintiff's claims One, Two, and Five through Ten were dismissed as legally frivolous. Pursuant to and in accordance with the Order entered by Judge Robert E. Blackburn, on May 9, 2008 [#213] adopting and approving the Magistrate's recommendation which is incorporated herein by reference as if fully set forth, It is ORDERED : 1. That the Recommendation of the Magistrate Judge on Defendants' Motion for Summary Judgment (Docket No. 195) [#205], filed March 27, 2008, is APPROVED AND ADOPTED as an order of this court; and

Civil Action No. 01-cv-01917-REB-MJW Judgment 2. That the plaintiff's claims against the defendants are DISMISSED WITHOUT PREJUDICE for failure to exhaust administrative remedies; 3. That judgment is ENTERED for defendants, John Reilly, Richard Graham, and Charlie Pellitier , and against the plaintiff, Dennis Michael Blay, as to all claims and causes of action asserted; and 4. That the defendants are AWARDED their costs, to be taxed by the Clerk of the Court pursuant to Fed.R.Civ.P. 54(d)(1) and D.C.COLO.LCivR 54.1.
