ORDER WAIVING THE APPEARANCE OF DEFENDANT FOR HEARING ON FEBRUARY 1, 20087

THIS MATTER is before the Court on Defendant's Unopposed Motion for Order Waiving the Appearance of Defendant for Hearing on February 1, 2008 (filed December 6, 2007). I find good cause for the waiver and find the waiver to be knowingly and voluntarily made. Further, I note that Defendant is not required to be present at the hearing in February pursuant to FED. R. CRIM. P. 43 as the hearing involves a legal question. Accordingly, it is ORDERED that Defendant's Unopposed Motion for Order Waiving the Appearance of Defendant for Hearing on February 1, 2008 is GRANTED. The Court waives Defendant's appearance at the hearing on February 1, 2008. It is FURTHER ORDERED that the Bureau of Prisons, ADX, Florence, is directed to facilitate a live video-audio feed for the February 1, 2008, hearing under the same conditions as it did for the hearing on December 3 and 4, 2007.
