STATUS REPORT REGARDING TESTIMONY OF DR. DAVID LOVEJOY

The United States of America, by Troy A. Eid, United States Attorney for the District of Colorado, and through Brenda K. Taylor and Philip A. Brimmer, Assistant U.S. Attorneys, respectfully advises the Court as follows of the status of discussions between the parties regarding the testimony of defense expert Dr. David Lovejoy: 1. At the trial preparation conference on February 27, 2008, the Court directed the parties to meet and confer regarding the testimony of Dr. David Lovejoy, a defense expert on the issue of William Sablan's mental health at the time of the homicide. 2. The parties have had discussions about this matter, and defense counsel has attempted to make Dr. Lovejoy available to government counsel for an interview. However, Dr. Lovejoy has been unavailable since February 27, 2008 due to illness. 3. Once Dr. Lovejoy can be interviewed by the government, the parties will file a supplemental status report advising the Court of any remaining contested issues regarding his testimony.
