ORDER FOR SERVICE OF SUBPOENA DUCES TECUM IN FORMA PAUPERIS

This matter coming to the attention of the Court on the motion of the defendant for an order that a subpoena duces tecum be issued in forma pauperis, it is, therefore, ORDERED that the motion be granted and that the Clerk of the Court issue a subpoena duces tecum for the time of hearing for the appearance of the witness named as follows: Victor Stone, Special Counsel, Director's Office, Office of Enforcement Operations, Criminal Division, Department of Justice, Washington, D.C. Appearance Date: March 7, 2008, at 11:00 a.m. And to Produce: 1. All documents relating in any way to the WITSEC determination that witness Arthur Peck's notification as a convicted sex offender should be waived. (See Memorandum Peck 049190.) 2. The WITSEC memorandum of understanding with Arthur Peck including any attachments and supporting documents. 3. An unredacted copy of the June 22, 2004 psychological evaluation of Arthur Peck. 4. The WITSEC memorandum of understanding with Jay Vought.

IT IS FURTHER ORDERED that the Clerk of the Court shall call defendant's counsel to pick up subpoena when it is issued. Counsel will obtain service through acceptance by the government. IT IS FURTHER ORDERED that the prepayment of the fees and that the witness fees, mileage and subsistence of said witness be paid by the U.S. Marshal and taxed as costs in favor of the United States.
